Walker Medical Wellness Web Site Terms of Service

Please read the following Terms of Service (the “Terms“) carefully. The Terms govern your access to and use of the WALKER MEDICAL WELLNESS web site located at www.walkermedicalwellness.com (the “Site“), and constitute a binding legal agreement between you, as a user of the Site, and Walker Medical Wellness. When we use the terms “Walker Medical Wellness” or “we” or similar terms we are referring to Walker Medical Wellness. “You” or “your” or similar terms refer to you as a user of the Site.

The Site has been designed to provide general information about Walker Medical Wellness e-health service. The Site is not intended to provide medical advice, nor does it provide instructions on the appropriate use of our Walker Medical Wellness e-health service or any other products or services offered by Walker Medical Wellness or its licensors or strategic partners. Registered users receive instructions on the use of our Walker Medical Wellness e-health service when they register with us and access our secure Walker Medical Wellness portal.

By your use of the Site, you consent to the collection, use, and disclosure of your information in accordance with our Privacy Policy. Please refer to our Privacy Policy, which is incorporated into and made a part of the Terms, for more information. Please also refer to our Notice of Privacy Practices.

The Site, and all information and/or content that you see, hear, or otherwise experience on the Site (collectively, “Content“) are protected by U.S. and international copyright, trademark, and other laws. We own or have the license to use all of the intellectual property rights relating to WALKER MEDICAL WELLNESS, the Site, and the Content, including, without limitation, all intellectual property rights protected as patent pending or patented inventions, trade secrets, copyrights, trademarks, service marks, trade dress, or proprietary or confidential information, and whether or not they happened to be registered. You will not acquire any intellectual property rights in WALKER MEDICAL WELLNESS by your use of the Site.

Subject to your compliance with the Terms, Walker Medical Wellness grants you a limited, non-exclusive, non-transferable and revocable license, without the right to sublicense, to access and use the Site and to download and print one copy of the Content solely for your personal and non-commercial purposes. You may not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Site or our Content, except as expressly permitted in the Terms, without Walker Medical Wellness’s express prior written consent.

We may make available on our Site links to third-party websites or resources and advertisements from third parties. Stat Health is not responsible or liable for the availability or accuracy of, and Stat Health does not endorse, sponsor, or recommend any such websites, resources, or third-party advertisements or the content, products, or services on or available from them. When we make them available, you must look solely to the third party with respect to the content, products, or services they provide. YOUR USE OF THE WEBSITES OR RESOURCES OF THIRD PARTIES IS AT YOUR OWN RISK. WALKER MEDICAL WELLNESS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY OF YOUR LOSSES ARISING OUT OF OR RELATING TO THE WEBSITES OR RESOURCES OF THIRD PARTIES.

We will use reasonable efforts to include accurate and up-to-date information on the Site, but we make no warranties or representations concerning the accuracy of information presented on the Site. Your use of the Site and Content is at your sole discretion and risk. The Site and Content are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind.

NEITHER WALKER MEDICAL WELLNESS NOR ANY PARTY INVOLVED IN CREATING, PRODUCING OR DELIVERING THE SITE SHALL BE RESPONSIBLE FOR ANY DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS, ARISING OUT OF YOUR ACCESS, USE OR INABILITY TO USE THE SITE, OR ANY ERRORS OR OMISSIONS IN THE CONTENT OF THE SITE.

The Terms constitute the entire agreement between you and us relating to the Site and the Content, replacing any prior or contemporaneous agreements, whether written or oral. The failure by you or us to enforce any provision of the Terms will not constitute a waiver.

THE TERMS AND OUR RELATIONSHIP WITH YOU SHALL BE GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA, EXCLUDING ITS CHOICE OF LAWS RULES. THE EXCLUSIVE VENUE FOR ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THE TERMS OR OUR RELATIONSHIP WITH YOU, REGARDLESS OF THEORY, SHALL BE THE U.S. DISTRICT COURT FOR THE DISTRICT OF CALIFORNIA LOCATED IN SACRAMENTO, CALIFORNIA OR THE STATE COURTS LOCATED IN SANTA BARBARA COUNTY, CALIFORNIA; EXCEPT WALKER MEDICAL WELLNESS MAY COMMENCE AND MAINTAIN AN ACTION OR PROCEEDING SEEKING INJUNCTIVE OR OTHER EQUITABLE RELIEF IN ANY COURT OF COMPETENT JURISDICTION.

We reserve the right to change the Terms at any time. Any changes that we make will become a part of our agreement with you when they are posted to our Site. Your continued use of the Site will constitute your agreement to the changes we have made. The last date the Terms were revised is set forth at the end of this document.
